The California Consumer Privacy Act (CCPA) provides California residents with several rights regarding the collection, access to, deletion, and retrieval of certain personal information collected about them. These rights include the following*:

  • The right to request a list of the categories of personal information and specific items of personal information collected about you

Submitting a Request to Know, Request to Delete, or Request to Correct Inaccurate Personal Information

If you are a California resident seeking to make a Request to Know personal information collected about you, a Request to Delete personal information collected about you, or a Request to Correct Inaccurate Personal Information we maintain, those requests can be made by completing the following web form, located here, or by calling 866.760.3840

In order to process your Request to Know, Request to Delete, and/or Request to Correct, you must provide the following information so that Credit Acceptance can verify your identity by comparing the personal information you provided to us against the records in our systems: 

  • Name

  • Address

  • Phone Number

  • Account Number (if applicable)

  • The nature of your relationship with Credit Acceptance, which can include any combination of the following:

    • A consumer applying for credit and/or a customer of Credit Acceptance;

    • Employed by a business that conducted business with Credit Acceptance;

    • Employed by a dealer that conducted business with Credit Acceptance;

    • Applied for employment with, or was employed by, Credit Acceptance

  • If making a Request to Correct, you must also describe the personal information that you believe is inaccurate, provide the correct/updated personal information, and be prepared to provide supporting documentation to support the change

  • If you wish to receive a response via mail, the address to which the response should be sent

  • If you wish to receive a response via e-mail, the e-mail address to which the response should be sent

Making requests on behalf of others

If you wish to make a Request to Know, Request to Delete, or Request to Correct on someone else’s behalf, you must submit the request to the mailing address or e-mail address specified above, and include one of the following documents with the completed form

  1. Written, signed authorization from the consumer giving the individual identified the authority to make a Request to Know, Request to Delete, or Request to Correct on their behalf; OR

  2. An authorized power of attorney pursuant to California Probate Code Sections 4000 to 4465 which sufficiently provides the authorized party with the authority to make a Request to Know and/or a Request to Delete, or generally access an individual’s personal information. 

Failure to submit a Request to Know, Request to Delete, or Request to Correct on someone else’s behalf as specified will result in the request being denied.

*Note: The CCPA does not apply to the collection, processing, and disclosure of certain personal information, including personal information collected subject to the Gramm-Leach-Bliley Act (GLBA). This includes all personal information collected for a financial product or service for personal, family, or household purposes.

For consumers applying for credit, or financing a vehicle, through Credit Acceptance, all consumer personal information Credit Acceptance has collected, will collect, processes, has shared or disclosed is personal information subject to the GLBA, and is used only for purposes of originating or servicing an account, or processing an application for credit.

Although Credit Acceptance has established methods and procedures for these consumers (who have applied for credit or financed a vehicle with Credit Acceptance) to make Requests to Know and Requests to Delete their information, all consumer personal information Credit Acceptance collects about them is exempt from the CCPA. As a result, our responses to these requests will be that the personal information is exempt from deletion and disclosure.

Credit Acceptance may collect your personal information from the following categories of sources:
  • From you directly

  • From credit reporting agencies

  • From automobile dealers and third party websites used by automobile dealers to generate customer leads

  • From collection service providers

  • From consumer verification service providers

  • From bank verification service providers

  • From payment processing service providers,

  • From lien and titling vendors,

  • From data analytics service providers

  • From communication service providers

  • From web service and software providers

  • From government entities

For consumers applying for credit or financing a vehicle, Credit Acceptance does not disclose consumer personal information with service providers or contractors for any non-business purpose that does not relate to the originating or servicing of an account, or the processing of an application for credit.

Credit Acceptance does not knowingly collect the personal information of any consumer 16 years old or younger.

Although Credit Acceptance may disclose some or all of the categories of personal information described above to service providers and/or contractors in order to establish or maintain a consumer, employment, or business relationship, Credit Acceptance does not sell or share personal information to third parties, as those terms are defined in the California Consumer Privacy Act.

Credit Acceptance does not use or disclose Sensitive Personal Information (as described above) other than as necessary to originate and service a retail installment contract (for consumers applying for credit, or financing a vehicle through Credit Acceptance), or to establish and maintain a business or employment relationship (for consumers entering or attempting to enter an employment relationship with Credit Acceptance or a business relationship with Credit Acceptance as a dealer, service provider, or other vendor).

Credit Acceptance retains each of the above-listed categories of personal information for as long as required to fulfill business needs and satisfy legal obligations.
